NRC in Assam.

All Assam Student's Union (AASU) and Assam Gana Parishad around three decades ago demanded to update the NRC of 1951. On January 18, 1980, these organizations had submitted a memorandum to the Centre. The decision was made to update the NRC on 17 November 1999 at a tripartite meeting. Then center sanctioned funds to start the exercise.

As per the order of the Supreme Court process of NRC update was started in Assam in 2013. The aim of this process was to find out illegal migration from adjoining areas and Bangladesh. NRC is updated according to rules mentioned in the Assam Accord and under the Citizenship Act, 1955. On 30th July 2018 final list of NRC is released.

A person is eligible to be a citizen of India if he proves that either he or his ancestors were in India on or before midnight of March 24, 1971, under NRC. First is his name should appear in the NRC, 1951, or in a document issued up to midnight of 24th March 1971 or in Electoral Rolls up to the midnight of 24th March 1971 will be a proof of his presence in Assam or any other part of India on or before 24th March 1971.

Second is a person should prove linkage with a person whose name appears in the legacy data. Legacy Data are the names included together in the NRC, 1951, or in an Electoral Roll up to the midnight of 24th March 1971.

NRC Assam was conducted through a special exception for the state in the Citizenship Act, 2003. The whole process was overseen by the Supreme Court of India.

What after exclusion from NRC?.

If someone’s name excluded from the NRC then NRC does not by itself amount to him/her being declared a foreigner. Govt has said. “Such individuals will have the option to present their case before foreigner’s tribunals”.

If he loses his or her case in a tribunal, he or she can move the high court. If he or she loses his or her case in high court then he or she can move the Supreme Court of India.

But if any family failed to produce their document, is it so easy or bearable to go to tribunal, high court, and then-Supreme Court of India to file their case for common man or family?
